This Indenture made the
tenth Decr eighteen hundred thirty seven
between Josiah G Jordan of the County &
State aforesaid of the one part & Lewis J Rigsby of the County State
aforesaid of the other part Witnesseth that for in consideration of the sum of
one thousand dollars he the said Jordan hath this day date bargained sold
aliened conveyed confirmed unto him the said Lewis J Rigsby his heirs
executors administrators assigns a certain tract or parcel of land it being
lying in the fifth district to Section originally Cherokee now Floyd
Co Known distinguished in the plan of said district by number three hundred
Seventeen drawn by R H M Swain he the said Jordan by these presents
do bind himself his heirs executors administrators assigns Severally jointly
to him the said L J Rigsby by his heirs executors administrators in fee Simple
I will forever warrant defend the right title together with all the
appertaining to said premises to him the Said Rigs by his heirs against the
claim of himself the claims of all other persons whatsoever in witness
whereof I the said Jordan have hereunto affixed my Seal set my hand
the day date above written in presence of these witnesses

Know all men by these presents that I Lewis J Rigsby
of the County and State aforesaid for divers good
causes and considerations me hereunto moving
to have ordained constituted and appointed and
by these do make ordain constitute and appoint Pleasant I Foster of the said
State and County aforesaid my true and lawful attorney for me and in my name
and for my own proper use and benefit to bargain sell release convey and confirm
a certain tract or lot of land which was drawn by Richard H M Swan in the Land lottery
held at Milledgeville in the County of Floyd and State aforesaid which tract of
land is distinguished by lot No 317 in the 5th district of Said County and to do
all other lawful accounts and things whatsoever concerning the said tract or lot
of Land as fully and in every respect as I myself might or could do were
present at the doing thereof ratifying and confirming and by these presence
allowing whatsoever my said attorney in my name shall lawfully do in and
out the premises by virtue of the Peace in witness whereas I have hampt
Set my hand and affixed my seal This is the tenth day of October in the year of our
Lord one thousand Eight hundred thirty nine
